1. Introduction
Pursuant to Article 52 of the Consumer Code (Legislative Decree 206/2005), if you have entered into a contract as a consumer on SAPORIDITALIA.NET, you have the right to withdraw from the contract within 14 days without providing any reason, except as provided in the 'Exclusions from the Right of Withdrawal' section.
2. Withdrawal Period
The withdrawal period expires 14 days after the day on which you or a third party, other than the carrier and indicated by you, acquire physical possession of the goods.
3. How to Exercise the Right of Withdrawal
To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g., a letter sent by post, fax, or email). You may use the model withdrawal form provided, but it is not obligatory.
4. Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
5. Return of Goods
You are requested to return the goods or hand them over to the seller without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods.
6. Liability for Diminished Value of Goods
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
7. Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to the following cases:
- Supply of goods made to the consumer’s specifications or clearly personalized.
- Supply of goods that are liable to deteriorate or expire rapidly.
- Supply of sealed goods that are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery.
- Supply of digital content (such as e-books, software, etc.) that is not supplied on a tangible medium, once the performance has begun with the consumer's prior express consent and with the acknowledgment that they thereby lose their right of withdrawal.
**Note**: Many of our food products are perishable and subject to rapid expiration. Therefore, such products are excluded from the right of withdrawal under Article 59 of the Consumer Code. We invite you to contact the seller for any specific questions regarding the return of food products.
